Under no event shall the MES Builders Association of India(Regd.) or its office bearers will be liable for any special, direct, indirect consequences or incidental damages or any damages whatsoever, whether in an action, negligence or other tort, arising out of or in connection with the use of the service or the contract of service.
The identity of the information provider will be confidential. The identity of the information provided shall not be revealed. However, in case any member have posted objectionable information as stated above or in case of arising of any legal issue the identity of the information provider will be retrieved and revealed to the appropriate authority. The authority to retrieve the identity will be with a group of 10 or more individuals as decided by President. The identity will be retrieved only if all the authorized persons have unanimously agreed and log on to the system simultaneously.
In case any member is found to have violated any of the conditions mentioned from para 1 to 4 hereinabove shall render himself to a disciplinary action as per the provisions of M&AOA or as decided by the Council. Decision of the Council will be final and binding.
Standing instructions for the User
Pre-bid information is required to be posted at least 3 days prior to opening of tender. In case it is received later, the same shall not be accepted and information will be rejected.
The Pre-bid information should be restricted to the matters concerning the particular bid and its stipulations, specifications, action etc.
Post-bid information is required to be posted not later than 15 days from the date of opening of financial bid of the tender. In case it is received later than 15 days, the same shall not be accepted and information will be rejected.
The Post bid information should be restricted to information regarding low and unworkable rates. This is intended to ensure that the quantity and quality of such items where unworkable rates have been quoted should not suffer.
Only correct information should be posted, in case the information is found incorrect it will be summarily rejected and no action will be taken.
No un-parliamentary of derogatory language should be used while posting the information.
The data uploaded should match with the tender document.
